TQ WKTerms of Use
Who we are, and what you are agreeing to
TQ WK (torqueweek.com and the TQ WK apps) is run by Torque Week, Valparaiso, Indiana ("TQ WK", "we"). By creating an account, or by using the app or website in any way, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use TQ WK.
We wrote these terms in plain language on purpose. The short version: be decent to each other, post only what is yours and what is legal, and we will keep this a place worth being.
Who can be here
TQ WK accounts are for people 16 and older. If you are under 16 you may not create an account or use TQ WK. If we learn an account belongs to someone under 16 we will close it.
Community rules — zero tolerance
TQ WK has NO TOLERANCE for objectionable content or abusive users.
Objectionable content includes, without limitation: harassment, bullying or threats; hate speech or attacks on a person or group because of who they are; sexual content or nudity; graphic violence or gore; content that exploits or endangers minors; spam, scams, fraud and pyramid schemes; sale of stolen goods, weapons, drugs or anything illegal; impersonation; posting someone's private information; and anything else that is illegal or that a reasonable person would find grossly offensive.
Posting it, or abusing other users in any way, ends your ability to share content and can end your account, immediately and without warning. There is no second strike for the serious categories above. We may remove any content and suspend or terminate any account at our sole judgement, with or without notice.
How content is policed
- Before anything is posted, TQ WK checks the text on your device against a list of prohibited language and refuses to post it. Photos are screened after upload for explicit or violent content; photos that fail are removed and the listing or post they belong to is hidden.
- Every post, comment, video, listing, review, message and profile can be reported by any user, from the ⋯ menu.
- Content reported by more than one person is hidden automatically for everyone, pending review.
- Every report is reviewed by a person. We act on reports within 24 hours: content that breaks these rules is removed and the account that posted it may be suspended or ejected.
- We report content that exploits children, and credible threats of violence, to law enforcement.
Your tools
- Report: open the ⋯ menu on anything and choose Report. It is hidden from you at once and sent to our team.
- Block: the same menu's Block removes every trace of that person from your TQ WK — their posts, comments, videos, listings, reviews and messages — and ends any friendship between you. They cannot message you. You can unblock later in Settings → Blocked accounts.
- Reporting and blocking are anonymous. The other person is not told.
- If you believe we removed your content or suspended your account by mistake, email support@torqueweek.com and we will look again.
Your content
You own what you post. By posting it you give TQ WK a non-exclusive, royalty-free, worldwide licence to store, display, and distribute it inside TQ WK for as long as it is posted, so that the app can work. You are responsible for what you post, and you promise it is yours to post (or that you have permission), that it is accurate, and that it follows these terms and the law.
We respect copyright. If you believe content on TQ WK infringes your rights, email support@torqueweek.com with a link to the content, a description of the work you own, your contact details, and a statement that you believe in good faith the use is not authorised. We remove infringing content and close the accounts of repeat infringers.
Marketplace, tickets, and places to stay
TQ WK lets people buy, sell and trade with each other, buy event tickets, rent RV spots, rooms, homes and boats (for lodging only — never to operate), and book time in someone's garage bay. In every one of these, the deal is between you and the other person. TQ WK is not a party to it, does not own or inspect the items, does not guarantee any listing, seller, buyer, host, guest or event, and is not responsible for what happens between you.
- Payments made inside the app are processed by Stripe under Stripe's own terms. TQ WK keeps a platform fee of 5% of each transaction it processes; the rest goes to the seller, host or organizer. The fee is shown before you pay.
- Overnight stay bookings carry the cancellation policy the host chose — Flexible, Moderate or Strict — which is shown on the listing before you book and repeated in the rental agreement you both sign. Cancelling in the app applies that policy and refunds what it says to the card you paid with. A host who cancels refunds the guest in full whatever their policy says, a cleaning fee always comes back when nobody stays, and once a stay has started there is nothing left for the app to cancel.
- Garage bay bookings carry one rule instead of those three: free cancellation up to 24 hours before the block, and inside 24 hours the shop keeps half of what the block cost. A bay never carries a cleaning fee. Bays have to be booked at least two hours ahead, because you and the shop both sign the agreement before the bay opens.
- A booking that needs a signed rental agreement is not complete until both of you have signed. If either of you has not signed by the deadline the app shows on the agreement — for a garage bay, an hour before the block starts or a week from now, whichever is sooner; for an overnight stay, a week — TQ WK cancels the booking and puts the time back on sale. If the guest signed and the host did not, the guest is refunded in full. If the guest never signed, that counts as the guest cancelling and the listing's cancellation rule decides what comes back.
- A host may ask for a refundable damage deposit. TQ WK does not collect, hold, or release deposits. The amount is shown on the listing and written into the rental agreement you both sign, and the money moves directly between you — never through TQ WK. The agreement sets out what the deposit covers, how long the host has to inspect and claim, what a claim has to show, and when the rest comes back. TQ WK is not the judge of a deposit dispute and does not hold the money that would settle one.
- Everything else — Marketplace refunds, event tickets, deposits, and any dispute about what was delivered or what condition it was in — is between the two people, on the terms they set. We may help, but we do not have to. Marketplace payments made through the app are final: you tick that you understand this before you pay, and the seller may choose to refund you but is not required to. An organizer can refund a ticket or an entry fee, and a seller can refund an order, from inside the app, in part or in full; a refund goes back to the card that paid. Some ways of paying through the app may be switched off for a given week (for example, ticket or vehicle purchases); the app says so where the button would be.
- If your bank reverses a payment you made in the app (a chargeback), TQ WK answers the bank with what the app recorded: the ticket and the time it was scanned at the gate, the rental agreement you signed, the order and the listing. A ticket whose payment is under dispute is not valid at the gate until the bank decides. If the bank sides with you, what you bought is void; if it sides with the seller, the hold comes off.
- What may not be sold or traded on TQ WK, at all: firearms, ammunition, airsoft and BB guns, weapons of any kind, and parts or accessories for them; stolen property or parts with a ground-off, altered or missing serial or VIN; vehicles without a title in the seller's name, and vehicles whose title has been washed, salvaged without saying so, or that carry an odometer or title fraud; counterfeit, replica or knock-off branded parts and badges; emissions-defeat devices and delete kits; nitrous, fuel, oil, paint, solvents, batteries, airbags and other hazardous, pressurised or explosive materials; drugs, alcohol, tobacco and vape products; recalled items that have not been repaired; anything that requires a licence you do not hold; and anything else illegal to sell where you or the buyer are. Every listing carries the seller's statement that it is none of these. A listing that is, is removed and the account can be closed, with no refund of any fee.
- Selling, hosting or organizing through TQ WK means Stripe pays you. Money from a sale is released to your bank after the thing was delivered — the day after an event's last day for tickets and entries, a few days after a marketplace payment, the day after check-in for a stay or a bay — and the app shows you what is on hold and when it releases. Refunds and chargebacks on your sales come out of your balance, not TQ WK's. Stripe may ask you for more information at any time; until you provide it, payouts pause.
- Meet in public places, inspect before you pay, and never wire money outside the app to someone you have not met. Scams are a zero-tolerance violation; report them.
- Hosts are responsible for the safety and legality of what they rent and for any licences, taxes and insurance that apply. Guests are responsible for the property while they use it. Boats listed on TQ WK may not be driven, moved or taken off their mooring by a guest under any circumstances.
- A garage bay is workshop time, not lodging. Nobody may sleep in one. Lifts, jacks, stands, presses, torches, compressors, solvents and power tools are dangerous, and TQ WK has not inspected any of them. Use only equipment the host has shown you how to use, never work under a vehicle held up by a jack alone, and do not bring anyone under 18 into a bay unless the host agrees and an adult stays with them.
- Booking a place to stay on TQ WK does not make you a tenant, and does not create a lease. These are short stays by licence. If you and a host want something longer or different, that is an arrangement between you, outside TQ WK, under whatever law applies where the property is.
- Insurance is yours to arrange, on both sides. TQ WK provides none, is not an insurer, and is not a party to any policy. Check whether your homeowner's, renter's, auto, boat or business policy covers what you are about to do — most personal policies exclude paid use by other people.
- Event organizers are responsible for their events, their tickets, their refund policy and their safety.
Your account
Give us accurate information and keep it current. One person, one account. You are responsible for everything done with your account; keep your password private and tell us at once if you think someone else has used it. Do not use a phone number, email or name that is not yours.
You can delete your account at any time from your profile (Delete account) or at torqueweek.com/delete-account. Your profile, garage, schedule, friends, blocks, listings and contact data are deleted; your posts, comments and reviews are de-identified so conversations others took part in are not destroyed. Records of payments are kept as long as the law requires.
Driving, weather, and safety
TQ WK's drive, traffic, and weather features are for planning and information only. They can be wrong, late, or unavailable. Never operate a vehicle while using your phone. Do not rely on TQ WK for decisions that affect your safety — use official weather warnings, and the emergency services, for that. Crowd counts, travel times and weather are estimates.
Meeting in person, and the risk you accept
Almost everything TQ WK is for happens in the real world: cruise-ins, car shows, swap meets, a stranger's driveway, a garage bay, a boat on a mooring, a lot full of moving vehicles. TQ WK organises none of it, inspects none of it, supervises none of it, and is not there.
You understand that going to an event, meeting another user, entering someone's property, working in a garage bay, boarding a boat, or handling a vehicle carries real risk of property damage, serious injury and death — including from other people's carelessness. You take that risk on yourself. You agree not to make a claim against TQ WK, and to release TQ WK from any claim, for injury, death, or damage arising out of anything that happens in person between you and anyone you met, or any place or thing you found, through TQ WK.
TQ WK does not screen, background-check, verify or vouch for any user, host, guest, seller, buyer, organizer, property, vehicle, boat, tool or event. Photographs, descriptions, condition reports and reviews are written by users, not by us. Judge for yourself, bring someone with you, meet in daylight in public where you can, and walk away from anything that feels wrong.
If you are under 18, do not go to meet another user alone. You have to be 18 to book a garage bay and sign the agreement that goes with it — a parent or guardian can book it and be there with you — and nobody under 18 may be in a bay unless the host agrees and a responsible adult stays with them the whole time.
Insurance, and what it does not cover
TQ WK carries no insurance for you and provides none. It is not an insurer, a broker, or a party to any policy you hold. Most personal auto, homeowner's and renter's policies exclude paid use of your property or vehicle by other people, and most exclude commercial activity entirely — which is what renting a spot, a room, a boat or a bay is. Before you host or book anything, ask your own insurer, in writing, whether you are covered. If you are not, that gap is yours, not ours.
Advertising
TQ WK shows ads sold directly by TQ WK and marked as sponsored. We do not embed third-party ad networks and we never sell or share your personal data with advertisers. Advertisers must follow these terms too.
What we cannot promise
TQ WK is provided "as is" and "as available". We work hard to keep it running and accurate, but we do not promise it will be uninterrupted, error-free, or fit for any particular purpose, and we make no promise about any content, user, item, property or event on it.
To the fullest extent the law allows, TQ WK is not liable for any indirect, incidental, special or consequential loss, or for any loss arising from anything another user does or posts, and our total liability to you for anything connected with TQ WK is limited to the greater of the fees you paid TQ WK in the last twelve months or one hundred US dollars. Some places do not allow these limits; where that is so, they apply only as far as the law permits.
You agree to defend, indemnify and hold harmless TQ WK, its owner and anyone working for it, from and against any claim, demand, loss, liability, damage, fine, judgment, or cost — including reasonable legal fees — brought by anyone else and arising out of your content, your deals with other users, anything you rent out or rent, anything you sell or buy, any event you run or attend, injury or death or damage connected with any of that, your breach of these terms, or your breach of any law. We will tell you about the claim, and you may not settle anything that admits fault on our part or costs us money without our written agreement.
Nothing here makes either of us the other's employee, agent, partner or joint venturer. You are not authorised to speak for TQ WK or to bind it to anything, and TQ WK does not direct or control what hosts, sellers, buyers, guests or organizers actually do.
Neither of us is liable for a failure caused by something outside our reasonable control — storms, flooding, hurricanes, fire, power or network failure, a payment processor's outage, government action, or civil emergency. On the Gulf Coast that is not a hypothetical, and it is why nothing in TQ WK should be relied on for a decision about your safety.
Ending things
You can stop using TQ WK at any time. We can suspend or end your access at any time if you break these terms, if the law requires, or if TQ WK is discontinued; the zero-tolerance rules above apply without notice. Sections about your content, disclaimers, liability and governing law survive.
Changes and law
We may update these terms. When we make a material change we will ask you to agree again in the app before you continue. These terms are governed by the laws of the State of Indiana and the United States, and any dispute will be heard in the state or federal courts located in Indiana, unless the law where you live gives you a right you cannot waive.
